(9) Whereas, to ensure effective control, concentrations should be suspended until a final decision has been taken; whereas, on the other hand, it should be possible to waive a suspension, where appropriate; whereas, in deciding whether or not to grant a waiver, the Commission should take account of all pertinent factors, such as the nature and gravity of damage to the undertakings concerned by a concentration or to third parties, and the threat to competition posed by the concentration;
(9) considérant que, pour garantir un contrôle efficace, les concentrations doivent être suspendues jusqu'à l'adoption d'une décision finale; que, d'autre part, une dérogation à l'obligation de suspendre l'opération peut être accordée, le cas échéant; que, en décidant d'accorder ou non une dérogation, la Commission doit prendre en compte l'ensemble des facteurs pertinents, comme la nature et la gravité du dommage causé aux entreprises concernées par l'opération de concentration ou aux parties tierces et la menace que présente la concentration pour la concurrence;
